We will provide the insurance described in this Policy in return for the premium and compliance with all applicable provisions of this Policy. This insurance applies to the Described Location shown in the Declarations as “Location of Residence”, Coverages for which a Limit of Liability is shown and Perils Insured Against for which a Premium is stated. We cover: a. The dwelling on the Described Location shown in the Declarations, used principally for dwelling purposes, including structures attached to the dwelling; b. Materials and supplies located on or next to the Described Location used to construct, alter or repair the dwelling or other structures on the Described Location; and c. If not otherwise covered in this Policy, building equipment and outdoor equipment used for the service of and located on the Described Location. … We insure against risk of direct loss to property described in Coverages A and B only if that loss is a physical loss to property.

Facts and circumstances giving rise to the violation.

Insured filed a claim on the Insured Residential Property resulting from Hurricane Milton, with a date of loss of October 9, 2024.Insured immediately notified Insurer of the loss, and satisfied all other obligations under the policy, including allowing reasonable access to two separate field adjusters to the damaged and insured property for inspection. Insured supplied Insurer with all photographs of the damage as well as evidence of the costs of repair, namely the front doors to the residence, the roof to the residence, and the attached fences to the residence. Insured only repaired one damaged item, a single window pane, at the cost of $200, and proof of the same was sent to Insurer. The cost of repair to the roof is $31,175.00. The cost of repair to the front doors is $5,680.07. The cost of repair to the attached fences is $3,600.00. Together, with the cost of the window the sum total damages or gross loss is $40,655.07. Less Insured's Hurricane deductible of $9,180.00 totals a net loss of $31,475.07. This amount is exclusive of staining of ceilings resulting from leaks caused by the damage to the roof as well as damage to Insured's personal property caused by Insurer's agent RBD Roofing.
Instead, Insurer elected to ignore the evidence supplied by Insured and calculated Insured's net loss damages at $4,929.31, less than one sixth of the Insurer's obligation under the policy. Candace Zachary confirmed receipt of the evidence supplied by Insurer.
This violation may be cured by Insurer promptly paying Insured the difference between the amount already tendered, $4,929.31, and the net loss of net loss of $31,475.07, which is $ 26,545.76.
Although Insurer is in possession of the repair costs annotated above, they will be mailed to Insurer along with this Civil Remedies Notice.
