The department may provide financial assistance through any program authorized under s. 603 of the Federal Water Pollution Control Act (Clean Water Act), Pub. L. No. 92-500, as amended, including, but not limited to, making loans with principal forgiveness, providing loan guarantees, purchasing loan insurance or other credit enhancements, and buying or refinancing local debt. The EPA has provided direction that although the program is federally funded second tier funds may be used for water quality projects and classified as state funds, with respect to State Single Audit requirements, but are under the umbrella of federal funds which can't be charged state trust fund service charges.
A project sponsor shall submit a request for inclusion on the priority list to the Department to establish project ranking on the priority list as outlined in Chapter 62-503, F.A.C. and to determine the financing rate on the loan. The priority list shall be developed by the Department each year. The priority list shall be adopted at a public meeting held by the Department. The list becomes effective after adoption, but not before July 1 of the fiscal year for which it is developed.
A complete loan application shall be submitted to the Department within 120 days after the project is listed on the fundable portion of the priority list. The project sponsor (applicant) may incorporate into the loan application, by reference, any information previously submitted to the Department. If no loan application is received within this 120-day period, the project is subject to removal from the priority list at the next scheduled meeting.
To receive a loan, a project sponsor must submit a complete loan application, provide reasonable assurance that it has the financial capability to complete the project and repay the loan, and enter into a negotiated written agreement. Loan agreements shall be offered to project sponsors for projects listed on the fundable portion in the order of receipt of a complete application irrespective of priority score, project rank, or qualification for the small-community reserve funds.
If a project sponsor does not submit a complete loan application within 120 days, or a loan agreement is not executed within 210 days after a project is added to the fundable portion of the priority list, the project may be reviewed at the next priority list management meeting.
Rules for the program are found under Chapter 62-503, F.A.C.
